Terms of sale
1. Purpose
These terms of sale are entered into between, on the one hand, Créating, whose registered office is at 15 allée Faidherbe, 93190 Livry-Gargan, registered with the Trade and Companies Register under number 507921997 at the Bobigny registry, hereinafter referred to as “Pirsoum”, and internet users wishing to purchase a sending service on the platform accessible at https://pirsoum.net, hereinafter referred to as “the Client”.
These terms of sale of Créating define the rights and obligations of the parties in connection with the sale of services by https://pirsoum.net to the clients of the purchasing platform.
These terms express the entirety of the parties' obligations. The Client undertakes to read them carefully and to accept them before proceeding with payment of an order on the https://pirsoum.net platform.
The parties agree that their relations shall be governed exclusively by this contract, to the exclusion of any other terms. Given the specific nature of the product, the purchaser is invited to read these terms with care.
Créating reserves the right to adapt or amend these terms at any time. In the event of an amendment, the terms in force on the day of the order shall apply to that order. The purchaser is therefore invited to consult the latest version of the terms with each new order.
Should any provision be missing, it shall be deemed governed by the practices in force in the distance selling sector, in accordance with French law, which shall be the sole applicable law.
The Client must be:
- either a natural person over 18 years of age with full legal capacity to contract;
- or a natural person under 18 years of age who has been emancipated.
2. Products and services
Pirsoum provides a marketing campaign management and private messaging service on social networks.
In that context, Pirsoum puts in place the resources required to enable the Client to send their content as configured in their personal area, respecting the exact content uploaded, the scheduled dates and times, and the targets determined by our marketing agents on the basis of the information supplied by the Client.
Content is sent from the Client's own social media account. Their personal information is therefore kept strictly secure and confidential. That information is used solely to carry out the sending operations relating to the configured direct marketing campaign, and for no other purpose.
Pirsoum cannot be held liable for any interruption of service, or account suspension, by the social network concerned.
The right of withdrawal or refund is no longer available once the subscription taken out has begun.
The Client may request, at any time, a change to their targeting and to their marketing message.
The content published is the Client's responsibility. Créating cannot be held liable for content prohibited by the social networks.
Pirsoum reserves the right to refuse any content it considers undesirable and/or inconsistent with its image.
3. Intellectual property
All elements of the website www.pirsoum.net, whatever their nature, are protected by copyright, design rights, trademark law or patent law. They are the exclusive property of Créating. Reproduction of all or part of www.pirsoum.net constitutes infringement within the meaning of the French Intellectual Property Code.
4. Force majeure
Pursuant to article 1148 of the French Civil Code, Créating shall not be liable or deemed at fault in handling your file where any delay or non-performance results from an event of force majeure.
Any irresistible, unforeseeable event or circumstance beyond the parties' control shall be considered a fortuitous event or force majeure exonerating liability, including in particular total or partial strikes by carriers and natural disasters.
5. Severability
The fact that any provision of these terms becomes void, unenforceable, lapsed, unlawful or inapplicable by virtue of a law, a regulation or a court decision shall not affect the validity, legality or applicability of the other provisions, and shall not release the Client from performing their contractual obligations.
6. Disputes
These terms shall be performed and interpreted in accordance with French law. The parties shall seek an amicable settlement before any litigation.
In the event of a dispute concerning the validity, interpretation or performance of these terms, the courts of Paris shall have sole jurisdiction.
